Agreement Between the San Mateo Union High
School District and the Adult School Federation of Teachers
BREAK TIME Sideletter
In accordance with the current state practice of non-apportionment reimbursement
to districts for non-instructional time (including breaks), the District is requiring
adult school teachers to conduct class a full sixty (60) minutes for each hour
of posted instructional time. Teachers previously took a fifteen-minute (15) break
during each three-hour (3) class and received pay for a full three (3) hours.
The District received full reimbursement from the State for the entire time period.
Interested parties have challenged the current regulation, seeking to strike it
down to require the State to provide for a paid rest break within the three-hour
(3) time frame.
If the State eliminates the current regulation and permits
reimbursements to districts for breaks, the Federation and the District agree
either to revert to the previous paid fifteen-minute (15) break, or to adopt a
paid ten-minute (10) break if that is provided for in forthcoming legislation.
The Federation agrees to accept either alternative as a full and complete resolution
of its objection to the current regulation and the resulting District practice
of requiring teachers to conduct three-hour (3) classes without paid breaks. If
the challenge to the current State regulation is unsuccessful and the alternative
ten-minute (10) break is not enacted by the State, the Federation preserves any
right it has to challenge the District's compliance with current regulation as
a violation of the Agreement. The District also preserves any defenses it would
have if the Federation challenges the District's current practice.RELEASE
