Agreement Between the San Mateo Union High School District and the Adult School Federation of Teachers


ARTICLE XX: EFFECT OF AGREEMENT

It is the intention of the parties that this Agreement set forth the full and entire understanding of the parties regarding all matters set forth herein, and any prior or existing understanding or agreements by or between the parties, whether formal or informal, regarding any such matters are hereby superseded and terminated in their entirety.

Unless otherwise specifically provided herein, it is agreed and understood that each party hereto voluntarily waives and unqualifiedly relinquishes its rights to meet and negotiate, and agrees that the other party shall not be required to negotiate with respect to any subject or matter covered herein, or with respect to any matter not covered herein, even though such subject or matter may not have been within the knowledge or contemplation of either or both of the parties at the time they met and negotiated this Agreement, and even though any such subject or matter was proposed and later withdrawn.
However, if existing statutory mandates (e.g., tenure, dismissal, layoff) are changed to permissive statutes during the life of this contract, such items as deemed at that time to be within the scope of negotiations shall remain mandatory during the life of the contract, provided such rights or benefits remain permissible under law. The District agrees that no change regarding such items would be made until scope determination is made.

Any agreement, alteration, understanding, variation, waiver, or modification of any of the terms or provisions contained herein shall not be binding upon the parties hereto unless made and executed in writing by all parties hereto.
