Agreement Between the San Mateo Union High School District and the Adult School Federation of Teachers


ARTICLE XI: JOB SECURITY

Section 1. Assignment Of Teachers

Teaching assignments may be made at the discretion of the Director or his/her designee. Assignments shall be made in the best interests of the District and shall not be made for an arbitrary, capricious, or vindictive reason. Reasons for change in an assignment may include but are not limited to the following:
A. The need to provide particular course offerings for students as determined by the Director;
B. Adjustment for imbalances due to changing enrollment within the Adult School;
C. Changes in educational program as determined by the Director.

Section 2. Reassignment Of Teachers

Whenever practicable, employees being reassigned will be considered for a similar schedule to the immediately preceding assignment. The following criteria will be used:
A. Legal or state requirements;
B. The needs of the program;
C. Seniority of employee to be reassigned.

Section 3. Reduction In Staff
A. Permanent and Probationary Employees
Pursuant to the provisions of Education Code Sections 44955 and 44949, seniority shall be determined by the first day of rendered paid, unbroken service as a probationary Adult School Teacher. As between employees who first rendered paid, unbroken service to the District on the same date, the following criteria shall be used:
1. Education Code Section 44955(b).
2. The greater number of hours as an hourly certificated employee at the end of the year preceding the ranking shall have the highest seniority.
3. In the event that ties still exist, the remaining ties shall be broken by lot.

B. Temporary Teachers
Efforts will be made to retain temporary employees. Those with five (5) or more years of unbroken service and current assignments of nine (9) hours or more per week will be given priority over other temporary teachers.

Section 4. Seniority Dates
The District prepared seniority list of bargaining unit members will be made available to the Federation two (2) times per year, in October and March.
If the District announces a reduction in staff, the Director will provide a then-current seniority list within five (5) days of the Federation's request.
Beginning July 1, 2001, the District will recognize prior service credit for new hires who have previously taught at San Mateo Union High School District in the Adult School Program.
